General Terms and Conditions of Contract

1. Products and Services

  • Chesscul offers physical products (books, chessboards, chess materials) described with their photos, descriptions, prices, dimensions, and stock.
  • School services are offered online, in groups or private lessons, through digital platforms (e.g., Google Meet).

2. Prices and Taxes

  • All prices shown on the website include applicable taxes (corresponding VAT: books 4%, materials 21%).
  • All prices are shown in euros (€) and include VAT. Shipping costs and, where applicable, customs duties or local taxes (Canary Islands, Ceuta, Melilla, international) are not included in the price and are calculated separately.
  • Prices are valid at the time of your order/registration. Chesscul reserves the right to modify them, but changes will not affect orders already accepted.

3. Payment Methods

Chesscul accepts the following payment methods:

  • Debit/Credit Card
  • PayPal
  • Bizum
  • Bank Transfer

All payments are processed through secure and certified systems. For bank transfers, the order will be processed once proof of payment has been received or the amount verified. Chesscul reserves the right to verify payment validity and reject an order in case of fraud, non-payment, or incorrect data.

4. Purchase / Registration Process

  1. The customer selects products or lessons and adds them to the cart or registration form.
  2. They review their order: products, quantities, total price, shipping costs.
  3. They enter personal and full address information, and choose a payment method.
  4. They accept these Terms of Service, Privacy Policy, and Cookie Policy.
  5. They submit their order/registration.
  6. Chesscul confirms acceptance of the order/registration by email, indicating the estimated delivery date (for physical products) or the start date of the service (for classes; Chesscul reserves the right to confirm the start via WhatsApp to the number indicated on the form).

5. Shipping and Delivery (Physical Products)

  • Chesscul ships to:
    • Mainland Spain and Balearic Islands
    • Canary Islands (subject to customs/DUA charges where applicable)
  • The shipping company used is Correos Express.
  • Estimated delivery time: between 48 and 72 business hours for mainland Spain. Other destinations may vary depending on carrier and customs. Chesscul is not responsible for delays caused by the carrier or customs.
  • Shipping rates are calculated at checkout, based on actual or volumetric weight, package dimensions, and destination. The customer will see the cost before payment.
  • Free shipping for physical orders over €100 within mainland Spain only, except for bulky products (large boards or others) that may incur an additional fee.

6. Right of Withdrawal and Returns

  • The customer has the right of withdrawal within 14 calendar days from receiving the physical product. For school services, this right applies as long as the service has not yet started. If the customer consents to start before the 14-day period, the extended right is forfeited.
  • To exercise this right: contact Chesscul by email at alberto@chesscul.com indicating the order number and product(s) to return or service to withdraw from.
  • Returned items must be in new condition, unused, and in their original packaging.
  • Return shipping costs are borne by the customer unless the product is defective or the error is ours.
  • Refunds will be made as soon as possible and in any case within 14 days after receiving and verifying the returned product.
  • The right of withdrawal does not apply to (art. 103 LGDCU):
    • Customized products or items made to the customer’s specifications.
    • Sealed items that cannot be returned for health or hygiene reasons once unsealed.
    • Digital content supplied in a non-physical medium, when execution has begun with the consumer’s express consent.

7. Warranty and Liability

Chesscul’s liability is limited to the value of the order. They are not responsible for indirect damages, loss of profit, or misuse of products.

All new physical products (books, boards, chess materials, accessories) have a 3-year legal warranty against non-conformity, in accordance with the Spanish General Law for Consumer and User Protection.

Digital products and content (e.g., software licenses such as ChessBase) have a 2-year legal warranty, unless the contracted service duration is shorter, in which case the warranty covers the full contracted period.

The warranty covers manufacturing defects and excludes damages from misuse, impact, moisture, natural wear, or causes beyond Chesscul or the manufacturer’s control.

The customer has the right to request repair or replacement, or alternatively, a price reduction or contract termination, according to current regulations.

If a product arrives defective or damaged in transit, the customer must notify Chesscul within 24 hours of delivery, attaching photos of the packaging and product, to process the claim.

8. Classes / School Services

8.1 Modality and Access

  • All classes are conducted online via Google Meet (or another indicated platform). No special equipment is required other than an Internet connection and a device with microphone/camera.
  • Class recordings, if any, are used only for internal educational purposes. Chesscul will request prior consent if shared externally.

8.2 Enrollment and Fees

  • Enrollment is free.
  • There is no minimum commitment; the customer may cancel at any time.
  • Monthly fee, depending on group/level, is paid in advance.

8.3 Cancellations / Changes / Missed Classes

  • If a student needs to change groups, they may request it from Chesscul if there are available spots, giving at least 24 hours’ notice.
  • Missed group classes without notice cannot be rescheduled.
  • Private lessons may have a different policy, which will be indicated at the time of booking.

8.4 Right of Withdrawal for Services

  • The right of withdrawal (14 days) applies as long as the service has not yet started. If the service has begun with the customer’s consent before 14 days, withdrawal applies only to future sessions, not those already delivered.

8.5 Minimum Age and Parental Consent

  • Enrollment of minors (generally from 6 years old, subject to exceptions) is allowed only with parental or legal guardian consent.
  • For minors, their data must be provided by the person holding parental authority or guardianship.

9. Data Protection

  • Chesscul complies with the General Data Protection Regulation (GDPR) and the Spanish LOPDGDD.
  • Data controller: Chesscul.
  • Purposes: managing orders/registrations, sending marketing communications (with consent), and improving services.
  • Data processors include: payment platforms, carriers, Sendcloud, videoconference providers, hosting, etc.
  • Rights: access, rectification, erasure, objection, portability. You can exercise them by contacting alberto@chesscul.com.
  • Parental consent will be required for minors.

10. Intellectual Property

  • All site content (texts, images, logos, lessons, educational materials) is the property of Chesscul or third parties under license.
  • It may not be reproduced, distributed, or used without express authorization.
  • Students/users acquire no rights over the materials except those necessary for personal use within the contracted activity.
  • Access to the website or purchase of products does not grant any license or transfer of intellectual property rights.

11. Secure Payment Policies

  • The website applies security measures such as SSL/TLS encryption, secure payment gateways, and compliance with PSD2 / SCA regulations.
  • For card payments, the charge appears immediately; PayPal/Bizum payments are subject to their providers’ terms.
  • For bank transfers, the order will be processed once the payment has been fully credited.

  • Chesscul commits to responding to all complaints within a maximum of 14 calendar days. If you are not satisfied with the response, you may resort to mediation or arbitration according to applicable law.

13. Applicable Law and Jurisdiction

This contract is governed by current Spanish law and, where applicable, by European Union regulations. For any disputes arising between Chesscul and the Customer, both parties expressly submit to the Courts and Tribunals corresponding to Chesscul’s registered address, unless otherwise provided by applicable law.
